5 December UPDATE: New termination payment laws December 5, 2018 By Reef Admin Temination of employment 0 The Real Estate Industry Award and the Clerks – Private Sector Award have been varied regarding the timing of payments to employees on termination of their employment. From 1 November 2018, any entitlements due to an employee on termination of their employment need to be paid within seven (7) calendar days of the date of termination. This includes things like pay for time worked, accrued annual leave and, where applicable, long service leave and redundancy pay. Related Taking a pregnant pause: Unlawful termination due to pregnancy A recent court decision found that a real estate agency unlawfully terminated an employee on the final day of her probation period because she was pregnant and had taken personal and annual leave. A pressing necessity: Payment of pro rata long service leave In some States and Territories, long service leave legislation provides for a pro rata long service leave payment in certain circumstances upon termination of the employee’s employment.
